  • Reviews, ratings, and feedback you give or receive

  • In-app messaging between workers, contractors, and customers
  • Help & support conversations and attachments
  • Email or other support channels you use to contact us

3.4 Usage and Device Information

As you use the Platform, we automatically collect:

  • Pages visited, actions taken (e.g., opening a job, submitting a bid), and timestamps
  • Technical logs to keep the service secure and to diagnose problems

Our service worker may cache certain static assets for performance. We do not intentionally cache API responses containing sensitive personal data.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;
  • WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION OR CONTENT;
  • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE OPERATOR MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING:

  • The qualifications, credentials, licensing, insurance, background, identity, or reliability of any User, contractor, worker, or customer;
  • The quality, safety, legality, or suitability of any services, work, or materials provided by Users;
  • The accuracy of any information provided by Users, including profiles, reviews, ratings, or communications;
  • The outcome of any transaction, project, or interaction between Users.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES;
  • PERSONAL INJURY, BODILY HARM, OR DEATH arising from your use of the Platform or any services obtained through the Platform;
  • PROPERTY DAMAGE of any kind arising from your use of the Platform;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  • CONDUCT OF ANY THIRD PARTY on the Platform, including but not limited to defamatory, offensive, fraudulent, or illegal conduct of other Users;
  • ANY SERVICES, WORK, OR MATERIALS provided by contractors, workers, or other Users;
  • ANY FAILURE OR DELAY in performing any obligation under this Policy due to causes beyond our reasonable control.

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE OPERATOR'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE AMOUNTS PAID BY YOU TO THE OPERATOR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. ASSUMPTION OF RISK

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • Your use of the Platform and any services obtained through the Platform is AT YOUR SOLE RISK;
  • You are solely responsible for evaluating the qualifications, credentials, licensing, insurance, and suitability of any contractor, worker, customer, or other User;
  • You assume ALL RISKS associated with interactions, transactions, communications, and dealings with other Users;
  • The Operator is NOT A PARTY to any agreement, contract, or transaction between Users and has no control over the quality, safety, legality, or any other aspect of services provided by Users;
  • You assume all risks of PERSONAL INJURY, PROPERTY DAMAGE, FINANCIAL LOSS, and any other harm arising from your use of the Platform or services obtained through it.

13. INDEMNIFICATION

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE OPERATOR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND COURT COSTS) ARISING OUT OF OR RELATED TO:

  • Your use of or access to the Platform;
  • Your violation of this Privacy Policy or any applicable law or regulation;
  • Your violation of any rights of any third party, including other Users;
  • Any content, information, or materials you submit, post, or transmit through the Platform;
  • Any services you provide or receive through the Platform;
  • Any dispute between you and any other User;
  • Your negligent, reckless, or intentional misconduct.

This indemnification obligation shall survive the termination of your account and your use of the Platform.

14. NO LIABILITY FOR USER CONDUCT

THE OPERATOR IS NOT RESPONSIBLE OR LIABLE FOR:

  • The conduct, whether online or offline, of any User of the Platform;
  • Any content posted, transmitted, or shared by Users;
  • Any disputes, claims, or damages arising from interactions between Users;
  • The performance, quality, or outcome of any services provided by contractors, workers, or other Users;
  • Any criminal, tortious, or otherwise wrongful conduct by any User.

YOU RELEASE THE OPERATOR FROM ALL CLAIMS, DEMANDS, AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH DISPUTES BETWEEN YOU AND OTHER USERS.

The Platform may contain links to third-party websites or services. THE OPERATOR HAS NO CONTROL OVER AND ASSUMES NO RESPONSIBILITY FOR THE CONTENT, PRIVACY POLICIES, OR PRACTICES OF ANY THIRD-PARTY WEBSITES OR SERVICES. Your use of third-party services is at your own risk and subject to their terms and policies.

16. International Data Transfers

Our service providers may be located in different countries. Where required, we take steps to ensure appropriate safeguards are in place for transfers of personal data.

17. Children's Privacy

The Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will take steps to delete such information.
